General Terms
Eligibility and Lawful Use
You must be at least 18 years old to use this website and must satisfy all applicable age, residency, eligibility, identification, background-check, licensing, and other legal requirements for any product or service you request. You may not use the website or purchase products for a prohibited person, unlawful purpose, straw purchase, fraudulent transaction, or attempted evasion of any law or regulation.
Firearms, Ammunition, Suppressors, and Regulated Items
All firearm and National Firearms Act (“NFA”) transactions are subject to applicable federal, state, and local law, required documentation, background checks, waiting periods, agency approvals, and dealer procedures. A website order does not guarantee that a product may lawfully be transferred to you.
Firearms and other serialized products will be delivered only through a lawful transfer by Fallon Firearms or another properly licensed Federal Firearms Licensee (“FFL”), as applicable. They will not be shipped directly to an unlicensed customer’s residence. Suppressors and other NFA items will not be transferred until all required approvals are complete. We may cancel, delay, or refuse any order or transfer when reasonably necessary for legal compliance, safety, fraud prevention, inventory availability, or correction of an error.
The purchaser is responsible for providing accurate information and selecting a receiving FFL willing and legally able to accept the transfer. The receiving FFL may charge separate transfer or storage fees. A failed, delayed, denied, or canceled background check or agency application does not require Fallon Firearms to complete a transfer and does not automatically make processing, distributor, transfer, or service fees refundable.
Product Information, Availability, and Pricing
We make reasonable efforts to present accurate product descriptions, images, specifications, availability, and prices. Manufacturer and distributor information may change, and colors or appearance may vary by device or production run. We may correct typographical, pricing, inventory, or technical errors and may cancel an affected order before fulfillment. If payment has been collected for an order we cancel, we will issue the appropriate refund.
Products shown as available may be held by a distributor or fulfillment partner and may sell out before an order is processed. No order is accepted until we confirm it, receive required payment and information, and determine that fulfillment is lawful and available.
Orders, Payments, Taxes, and Fraud Prevention
You agree to provide current, complete, and accurate billing, shipping, contact, payment, and receiving-FFL information. You authorize us and our payment providers to process the amounts shown at checkout, including applicable taxes, shipping, and disclosed fees. We may request additional verification, place an order on hold, limit quantities, or cancel an order when information cannot be verified or fraud is suspected.
You are responsible for applicable taxes and charges presented at checkout and for separate fees charged by receiving dealers, government agencies, carriers, or other third parties unless we expressly agree otherwise in writing.
Services and Custom Work
Quotes, timelines, and results for Cerakote, engraving, stippling, porting, optic mounting, cleaning, gunsmithing, ATF Form 1 assistance, and other services depend on inspection, parts availability, project scope, and legal requirements. We may require a deposit or written approval before work begins. Customer-supplied designs, instructions, firearms, and components must be lawful, safe, and suitable for the requested work. We may refuse or stop work that presents a safety, legal, technical, or quality concern.
ATF Form 1 assistance is administrative assistance only and is not legal advice or a guarantee of approval. The applicant remains responsible for the accuracy and lawful submission of all information.
Accounts and Website Conduct
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly of suspected unauthorized access. You may not interfere with website operation, attempt unauthorized access, introduce malicious code, scrape the website in a manner that burdens or disrupts it, impersonate another person, submit false information, or misuse website content.
Intellectual Property
The website and its original text, graphics, branding, layout, photographs, and other content are owned by Fallon Firearms or used with permission and are protected by applicable intellectual-property laws. You may use the website for personal, lawful shopping and informational purposes. No other use, reproduction, distribution, modification, or commercial exploitation is permitted without prior written permission. Third-party product names and trademarks belong to their respective owners.
Third-Party Services and Links
The website may use or link to payment processors, distributors, shipping carriers, receiving FFLs, analytics providers, social-media platforms, manufacturers, warranty providers, and other third parties. Their services and policies are separate from ours. We are not responsible for third-party websites or acts outside our reasonable control, but this does not limit responsibilities that applicable law places on Fallon Firearms.
Disclaimers and Limitation of Liability
To the fullest extent permitted by law, the website is provided on an “as available” basis. We do not guarantee uninterrupted or error-free website operation. Product warranties, when available, may be provided by the manufacturer and are subject to the manufacturer’s terms.
To the fullest extent permitted by law, Fallon Firearms will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use or a transaction. Any direct liability will be limited to the amount paid to Fallon Firearms for the product or service giving rise to the claim. These limitations do not apply where prohibited by law and do not waive nonwaivable consumer rights or remedies.
Governing Law and Disputes
These Terms are governed by the laws of the State of Louisiana and applicable federal law, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction serving St. Charles Parish, Louisiana, unless applicable law requires another forum. Before filing a claim, please contact us at info@fallonfirearms.com so we have a reasonable opportunity to address the issue.
Changes, Severability, and Entire Agreement
We may update these Terms by posting a revised version and effective date. The version in effect when an order is placed generally governs that order, except where a change is required by law. If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with any written quote, order confirmation, service authorization, or policy expressly incorporated into them, constitute the agreement concerning the website and applicable transaction.
Firearm Storage Policy
Effective date: July 17, 2026
This policy applies to each firearm, suppressor, serialized product, or other regulated item received by Fallon Firearms for a transfer, repair, customization, gunsmithing, or other service.
Notice and 30-Day Pickup Period
When a transferred item is available for lawful pickup, or when custom work or another service is complete, Fallon Firearms will notify the customer using the contact information provided. The customer has 30 calendar days from the date of the first notice to complete all lawful transfer or release requirements and collect the item. The 30-day period does not begin while Fallon Firearms is still performing the requested work or while the item cannot lawfully be released because Fallon Firearms is awaiting a required government approval outside the customer’s control.
If a background check is denied, the customer is otherwise ineligible to receive the item, or the item cannot lawfully be released to the customer, the customer must contact Fallon Firearms promptly to arrange another lawful disposition. Fallon Firearms is not required to release an item contrary to law.
Storage Fees
Beginning on the 31st calendar day after the first notice, a storage fee of $10 per calendar day per item will accrue. All accrued storage charges and other amounts lawfully due must be paid before an item is released or otherwise transferred. Storage fees continue to accrue until the item is collected or lawfully disposed of, unless Fallon Firearms agrees to different terms in writing.
Unclaimed Items and Lawful Disposition
If accrued storage charges equal or exceed Fallon Firearms’ reasonable documented estimate of an item’s fair market value, Fallon Firearms may treat the item as unclaimed or abandoned for purposes of beginning a lawful disposition process. Ownership does not transfer automatically merely because storage charges reach the item’s value.
Fallon Firearms may exercise any lawful possessory, lien, or contractual rights and, only after providing any notice and observing any waiting period required by applicable law, may sell, transfer, surrender, or otherwise dispose of the item through lawful channels. Any firearm or regulated item will be transferred or disposed of only in compliance with applicable federal, state, and local law and required FFL recordkeeping procedures. Proceeds may be applied to unpaid storage fees, service charges, costs of notice, and lawful disposition expenses; any remaining balance will be handled as required by law. The customer remains responsible for any lawful unpaid balance.
Customer Responsibilities and Extensions
Customers are responsible for keeping their telephone number, email address, and mailing address current and for responding promptly to pickup notices. A customer who needs additional time must request a written extension before the 30-day period expires. Any extension is at Fallon Firearms’ discretion and does not waive legal transfer requirements or charges unless confirmed in writing.
State and Local Restrictions Policy
Effective date: July 17, 2026
This policy applies to firearms, ammunition, magazines, suppressors and other NFA items, receivers, frames, parts, accessories, knives, and any other product whose purchase, possession, configuration, shipment, or transfer may be restricted by federal, state, or local law.
Products Must Be Lawful at the Destination
Fallon Firearms will not knowingly ship, sell, or transfer a product to a person or destination when the transaction, product, configuration, capacity, possession, or use would violate applicable law or a published ordinance. Laws may differ by state, county, municipality, and other jurisdiction and may change without notice. Product availability on the website does not mean that the product is lawful in every jurisdiction or for every customer.
Restrictions may include, without limitation, firearm type or feature restrictions, magazine-capacity limits, ammunition restrictions, approved-product rosters, licensing or permit requirements, waiting periods, age requirements, identification requirements, NFA restrictions, shipping limitations, and rules imposed by a receiving FFL or carrier.
Customer and Receiving-FFL Responsibilities
Before ordering, the customer is responsible for confirming that the product and transaction are lawful in the customer’s state and locality and that the selected receiving FFL is willing and legally able to accept and transfer the item. The customer must provide accurate residency, delivery, permit, license, and receiving-FFL information and must not request a shipment, modification, or transfer intended to evade any restriction.
The receiving FFL makes its own determination whether it may lawfully receive and transfer an item. Fallon Firearms may request written confirmation from the receiving FFL or other documentation before fulfillment. Fallon Firearms’ review does not constitute legal advice or relieve the customer or receiving FFL of their own legal responsibilities.
Restricted or Ineligible Orders
Fallon Firearms may place an order on hold, request additional information, substitute a lawful configuration with the customer’s approval, or cancel or refuse an order or transfer when legal eligibility cannot be confirmed. We are not required to alter a product, remove included components, or separate a package to make an otherwise restricted order eligible.
If an order is canceled before distributor processing or shipment because it is restricted at the destination, any refund will be handled under the Refund & Return Policy. If processing or shipment has already begun, the customer may be responsible, to the extent permitted by law, for nonrefundable distributor charges, payment-processing costs, shipping, return shipping, receiving-FFL fees, lawful storage charges, and disclosed restocking or cancellation fees. Any refund due will be issued after the product is lawfully returned and the applicable charges are determined.
Items Rejected After Shipment
If a receiving FFL or carrier rejects an item, or if the customer cannot lawfully take possession, the item must remain with a lawful custodian while Fallon Firearms coordinates an authorized return, transfer to another eligible FFL, or other lawful disposition. The customer may not direct the receiving FFL to release a restricted item or component contrary to law. Storage charges may apply under the Firearm Storage Policy when an item is held by Fallon Firearms.
Quick Reference: States and Jurisdictions With Common Product Restrictions
Reviewed: July 17, 2026. This list is intended only as a screening reference for commonly encountered statewide restrictions on firearm types, features, and magazine capacity. It is not a complete statement of every law or exception. “Restricted” may mean prohibited, limited to exempt persons, subject to registration or permits, or unavailable for ordinary retail sale.
- California: Restricts defined assault weapons, .50 BMG rifles, many handgun models not listed on the state roster, and magazines capable of holding more than 10 rounds.
- Colorado: Restricts magazines capable of holding more than 15 rounds. Beginning August 1, 2026, sales and transfers of specified semiautomatic rifles, shotguns, and gas-operated semiautomatic handguns with detachable magazines require the purchaser to satisfy statutory eligibility and training requirements, subject to exemptions.
- Connecticut: Restricts defined assault weapons and magazines capable of holding more than 10 rounds.
- Delaware: Restricts defined assault weapons and magazines capable of holding more than 17 rounds.
- District of Columbia: Restricts defined assault weapons and magazines capable of holding more than 10 rounds.
- Hawaii: Restricts defined assault pistols and detachable magazines capable of holding more than 10 rounds when designed for or capable of use with a pistol.
- Illinois: Restricts defined assault weapons, assault-weapon attachments, .50-caliber rifles and cartridges, magazines holding more than 10 rounds for long guns, and magazines holding more than 15 rounds for handguns.
- Maryland: Restricts defined assault long guns, assault pistols, and copycat weapons. State law prohibits manufacturing, selling, offering, purchasing, receiving, or transferring detachable magazines holding more than 10 rounds; the magazine provision does not itself prohibit mere possession.
- Massachusetts: Restricts defined assault-style firearms and large-capacity feeding devices, generally those holding more than 10 rounds or more than five shotgun shells.
- New Jersey: Restricts defined assault firearms and magazines capable of holding more than 10 rounds.
- New York: Restricts defined assault weapons and magazines capable of holding more than 10 rounds. A state license is also generally required to purchase or take possession of a semiautomatic rifle.
- Rhode Island: Restricts magazines capable of holding more than 10 rounds and, beginning July 1, 2026, the manufacture, purchase, sale, or transfer of defined assault weapons, subject to exemptions and grandfathering provisions.
- Vermont: Restricts magazines capable of holding more than 10 rounds for long guns or more than 15 rounds for handguns.
- Washington: Restricts the manufacture, import, distribution, and sale of defined assault weapons and magazines capable of holding more than 10 rounds.
Oregon notice: Oregon Measure 114 contains a 10-round magazine restriction, but its implementation remains subject to a court injunction and continuing litigation as of the review date. Orders for Oregon should receive manual review rather than relying on the statutory text alone.
Definitions, exemptions, grandfathering rules, local ordinances, and court orders vary. Before shipping a potentially restricted product, Fallon Firearms may verify the current law and obtain confirmation from the receiving FFL. The principal reference for this screening list is ATF’s State Laws and Published Ordinances – Firearms, together with current state statutes and official agency guidance.
No State-by-State Guarantee
Because laws and local ordinances change, Fallon Firearms does not represent that any website list of restrictions is complete or current. We may rely on applicable law, current regulatory guidance, distributor or carrier restrictions, and information from the receiving FFL when making a fulfillment decision. Customers with questions about legality should consult their state or local authorities or a qualified attorney before ordering.
Shipping Policy
Effective date: July 17, 2026
This Shipping Policy applies to products purchased from Fallon Firearms.
Order Processing and Shipping Time
Orders are processed after payment, inventory, address, receiving-FFL information, and any required legal or fraud-prevention review are complete. Processing and delivery times vary by product, distributor, carrier, destination, and regulatory requirements. Any shipping estimate is an estimate rather than a guarantee unless we expressly state otherwise in writing.
If no shipping time is stated, we will have a reasonable basis to expect shipment within 30 days after receiving a properly completed order. If we cannot ship within the stated time or, when no time is stated, within 30 days, we will provide the customer an opportunity to agree to the delay or cancel the unshipped merchandise for a prompt refund as required by applicable law.
Firearms and Serialized Products
Firearms and other serialized products are shipped only to a properly licensed receiving FFL or transferred lawfully at Fallon Firearms. They are not shipped directly to an unlicensed customer’s residence. Before shipment, the receiving FFL must provide a current license and agree to accept the transfer. The customer is responsible for confirming the dealer’s willingness to receive the order and for dealer transfer, storage, background-check, or related fees.
The receiving FFL should inspect the firearm before completing the transfer. If the product is visibly damaged, incorrect, or materially not as ordered, the customer or dealer should contact us before the transfer is completed. Once a firearm has been transferred, return options are substantially limited and manufacturer warranty procedures may apply.
Suppressors and Other NFA Items
Suppressors and other NFA items are shipped or transferred only through lawful channels and after all required documentation, tax payments, background checks, and agency approvals. Approval and processing times are controlled by government agencies and are not shipping estimates. An NFA item will not be released before lawful approval.
Ammunition and Restricted Products
When offered for shipment, ammunition and other age-restricted or regulated products are shipped only where lawful and may require adult signature, identity or age verification, specific carriers, or other restrictions. They cannot be shipped to prohibited persons or jurisdictions. Carrier rules may prohibit certain products from post-office boxes or particular destinations.
Accessories, Optics, Parts, and Other Merchandise
Non-serialized products may be shipped to the lawful delivery address provided at checkout. Available services, charges, and delivery estimates are shown at checkout when supported. Some products may ship separately or directly from a distributor. We may choose a comparable lawful carrier service when operationally necessary.
Shipping Charges, Addresses, and Delivery
Shipping and handling charges are displayed at checkout or communicated before fulfillment. The customer is responsible for providing a complete and accurate address and, when applicable, correct receiving-FFL information. Contact us immediately if information is wrong. We cannot guarantee changes after processing or shipment begins, and the customer may be responsible for reasonable carrier, address-correction, return, reshipment, dealer, or storage charges caused by incorrect information, refusal, or failure to accept a lawful delivery.
Tracking information is provided when available. Delivery scans and signature records supplied by the carrier may be used to confirm delivery. Do not authorize delivery to a location where the shipment cannot be secured. International shipment is not available unless we expressly agree in writing and all legal and carrier requirements are satisfied.
Lost, Damaged, Incorrect, or Missing Shipments
Inspect shipments promptly. If an order is lost, arrives damaged, contains the wrong item, or is missing merchandise, email info@fallonfirearms.com within three business days after delivery or the expected delivery date. Include the order number, details, and photographs of the product, package, label, and damage when available. Retain all packaging while the claim is reviewed. We will work with the customer, carrier, distributor, and receiving FFL as appropriate and provide the remedy required by applicable law and our Refund & Return Policy.
Legal and Carrier Restrictions
We do not ship a product where shipment, possession, purchase, or transfer would violate applicable law or carrier rules. Orders may be held while legal eligibility or receiving-FFL information is verified. If an order cannot lawfully be fulfilled, it may be canceled, subject to the Refund & Return Policy and any nonrefundable costs lawfully incurred before the issue was identified.
Refund & Return Policy
Effective date: July 16, 2026
This Refund and Return Policy applies to purchases from Fallon Firearms, LLC (“Fallon Firearms,” “we,” “us,” or “our”). Because firearms, ammunition, regulated items, and custom services are subject to special safety, legal, and fulfillment requirements, different rules apply to different products.
Firearms, Ammunition, Suppressors, NFA Items, and Special Orders
All sales of firearms, ammunition, suppressors and other National Firearms Act (“NFA”) items, serialized products, and special-order or custom-order items are final once the order has been submitted to a distributor, shipped, transferred, or processing has begun. Exceptions may be made when an item is incorrect, damaged in transit, materially not as described, or when a refund is required by applicable law.
Firearms may not be returned or shipped directly to Fallon Firearms without prior written authorization. Any shipment or transfer of a firearm must comply with all federal, state, and local laws and may need to be handled through a licensed dealer.
Accessories and Optics
Eligible accessories and optics may be returned within 30 calendar days after delivery if they are unused, uninstalled, unaltered, in resalable condition, and returned with all original packaging, manuals, parts, and proof of purchase. Contact us before returning any product to receive return authorization and instructions.
Unless the return is due to our error, the customer is responsible for return shipping. Original shipping charges are nonrefundable. A restocking fee of up to 15% may apply to eligible returns where permitted by law.
Items That Cannot Be Returned
- Firearms, ammunition, suppressors, NFA items, and other serialized or regulated products
- Special-order, custom-order, modified, installed, used, or altered items
- Clearance or final-sale products
- Gift cards and downloadable products
- Hazardous materials or products that cannot lawfully or safely be returned
- Services that have already been performed or begun
Incorrect, Damaged, or Missing Items
Inspect your order promptly. If an item arrives damaged, is incorrect, or is missing from the shipment, email info@fallonfirearms.com within three business days after delivery. Include your order number, a description of the issue, and photographs of the product, packaging, and shipping label when available. Keep all packaging until the claim is resolved. If the issue is our error, we will provide an appropriate replacement, correction, or refund and cover reasonable return shipping.
Manufacturer Defects and Warranties
Many products are covered by a manufacturer warranty. After a firearm or other product has been accepted or transferred, manufacturer defects are generally handled through the manufacturer’s warranty process. We will provide reasonable assistance with manufacturer contact information when available. This section does not limit any rights provided by applicable law.
Cancellations
Before an order ships or processing begins, we may approve a cancellation subject to a fee of up to 10% to cover nonrefundable processing and distributor costs. Orders cannot be canceled after shipment, transfer, distributor submission, or the start of custom or regulatory processing. The cancellation fee does not apply when a full refund is required by law, including when we cannot ship within the promised time and the customer properly declines a delay.
Transfers, Background Checks, and Services
Firearm transfer fees, background-check-related fees, NFA transfer fees, ATF Form 1 assistance fees, gunsmithing, Cerakote, and other service fees are nonrefundable once the work or processing has begun. A delayed, denied, or canceled background check does not automatically entitle the customer to a refund for the firearm or related fees. Any disposition of a firearm remains subject to applicable law. Fees charged by a receiving or transferring dealer are the customer’s responsibility unless we agree otherwise in writing.
Refund Processing
Approved refunds are issued to the original payment method after the returned item is received and inspected. Processing times vary by financial institution. We do not substitute store credit when applicable law requires a monetary refund.
How to Request a Return or Refund
Email info@fallonfirearms.com with your name, order number, item, reason for the request, and supporting photographs when relevant. Do not send any product until you receive written return instructions.
